Nirbhaya Case (Pros and Cons)
All the four death row convicts hanged on 20th March 2020 in the aftermath of dastardly act of heinous crime of gang rape and murder of a 23 year old paramedic student,a dreadful event which shook the country's conscience , categorised as 'rarest of rare'by the court.Convicts took all possible measures and delay tactics to escape from gallows but eventually the law took its own course and made criminals pay their dues.It took nearly 7 yrs. and 3 months to exhaust their all judicial proceedings and legal remedies.It is worth remembering that being a too much media hyped case its time interval is too much as we know 'Justice delayed is Justice denied'. The proper closure of this case happened only when all the four pillars of democracy worked in tandem.
Many aspects of jurisprudence of IPC and Cr.PC and its loopholes are unraveled in public domain through this case. We should contmplate whether death penalty works as a deterrent because the Fast track court awarded death sentence to the convicts within nine months from the dreadful event as a preemptive action but still rape Cases are rampent in our society NCRB report enumerates 17000 cases pending of rape,molestation etc.This case also has laid bare whether death penalty is only for low social strata or is it same for all categories irrespective of cast ,creed,powered,perked,privileged and underprivileged.Some high profile cases of rape,molestation done by those who are in power position but still they are enjoying all luxuries in prisons. These cases are actually a big question mark on independence of our judiciary.Is it possible that powerful people would ever face death sentence like Ram rahim, Kuldeep sengar, Asharam, Swami Chinmayanand, or Our former CJI ranjan gogoi who himself is accused of molestation ,I think it's all pipedream.Gender Justice is still a far cry in our country and is an obstruction of country's promising future growth. It is a big concern which should take into account to launch our country at the top.
